Terms of Service
1. Scope & Provider
These Terms of Service govern the contractual relationship between you and AMPMUSE, operated by Roman Halva, Marienstraße 2, 12459 Berlin, Germany (“we”, “us”), regarding the use of ampmuse.com and the purchase of our digital products (sample packs, templates), courses and other services. They apply in the version valid at the time of the order.
2. Conclusion of Contract
The presentation of products in our shop does not constitute a binding offer. By placing an order you submit a binding offer to purchase. The contract is concluded when we accept your order, e.g. by an order confirmation or by providing access to the digital product.
3. Prices and Payment
All prices are final prices and include statutory value-added tax (VAT) where applicable. Payment is processed via the payment methods offered at checkout. Payment is due immediately upon conclusion of the contract.
4. Delivery of Digital Products
Digital products are provided as a download or via access made available after successful payment. It is your responsibility to ensure you have suitable hardware and software (e.g. a DAW) to use the files.
5. Licence and Permitted Use
Upon full payment, we grant you a non-exclusive, worldwide, non-transferable right to use the purchased samples and content. The samples are royalty-free: you may use them in your own music productions, recordings, DJ sets and commercial releases. You may not resell, redistribute, sub-license, share or otherwise make the samples available as samples (whether individually, repackaged, or as part of another sample library/pack), nor make them available in a way that allows third parties to extract the underlying sounds. All intellectual property rights in the products remain with us.
6. Right of Withdrawal
If you are a consumer, you have a statutory right of withdrawal. Please see our Right of Withdrawal & Refund Policy, which also explains the early expiry of the right of withdrawal for downloaded digital content (§ 356 (5) BGB).
7. Warranty and Liability
Statutory warranty rights apply. We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. For slightly negligent breaches of essential contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. This does not affect liability under the German Product Liability Act (Produkthaftungsgesetz).
8. Governing Law & Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
9. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
10. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
