End User License Agreement (EULA)
This License Agreement (“Licence”) governs your use of the digital products — sample packs, individual samples, presets, project files and templates (collectively, the “Content”) — purchased or downloaded from AMPMUSE, operated by Roman Halva, Marienstraße 2, 12459 Berlin, Germany (“we”, “us”). By downloading or using the Content, you (“you”, the “Licensee”) agree to this Licence. This Licence supplements our Terms of Service.
1. Grant of Licence
Upon full payment, we grant you a non-exclusive, worldwide, perpetual, non-transferable licence to use the Content as set out below. We (or our licensors) retain all ownership and intellectual property rights in the Content. You are licensed to use the Content; you do not purchase the Content itself.
2. What You May Do (Permitted Use)
The samples are royalty-free. You may, without paying any further fees:
- Use the Content to create your own original music productions, recordings, beats, songs and sound design.
- Release and commercially exploit music that incorporates the Content (streaming, downloads, physical media, sync in film/video/games, live performance and DJ sets).
- Modify, edit, time-stretch, pitch, layer and process the Content within your own productions.
3. What You May Not Do (Restrictions)
- You may not resell, redistribute, lease, sub-license, share, upload, or give away the Content, in whole or in part, whether in its original form, modified, repackaged, or as part of another sample library, preset pack, template, construction kit or sound bank.
- You may not make the Content available in any way (e.g. in a stem, multitrack, project file, NFT, or AI training dataset) that allows a third party to extract, isolate or reuse the underlying individual sounds as samples.
- You may not register, claim or assert any copyright, trademark or other exclusive right in the Content itself.
- You may not use the Content in any product that competes with AMPMUSE (e.g. another sample pack, preset library or template).
- You may not use the Content in a manner that is unlawful, defamatory, or that infringes the rights of others.
4. Content Identification / Content ID
Because the Content is non-exclusive and licensed to many users, you may not register tracks containing unaltered Content with content-recognition or monetisation systems (e.g. YouTube Content ID) in a way that could block or claim other licensees’ legitimate use of the same Content.
5. Presets and Templates
For presets and templates, the same principles apply: you may use them to create and release your own music, but you may not redistribute or resell the preset/template files themselves, nor make them available as standalone downloadable assets.
6. Ownership and Reservation of Rights
All Content is protected by copyright and remains the intellectual property of AMPMUSE and/or its licensors. All rights not expressly granted to you under this Licence are reserved.
7. Term and Termination
This Licence is effective upon download and continues unless terminated. We may terminate this Licence with immediate effect if you materially breach it (in particular Section 3). Upon termination you must cease all use of the Content and delete all copies in your possession; music already lawfully released before termination may remain in distribution.
8. Warranty and Liability
The statutory warranty and liability provisions of our Terms of Service apply. The Content is provided for use in music production; you are responsible for ensuring you have suitable software and hardware.
9. Governing Law
This Licence is governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, mandatory consumer-protection provisions of your country of habitual residence remain unaffected.
